Pa. Judge Says USCIS Must Redo Spousal Petition After Delay

By Rae Ann Varona (August 3, 2022, 6:41 PM EDT) — A Pennsylvania judge ordered U.S. Citizenship and Immigration Services to reconsider a man’s petition for his Turkish wife’s green card, saying the agency’s unreasonable delay in denying the petition unfairly hampered the couple’s ability to address the agency’s concerns.

U.S. District Judge Joseph F. Leeson Jr. said Tuesday that other courts have already found USCIS delays of between two and four years to be unreasonable, and the agency took more than six years to make its decision on Olando Espinal’s request to sponsor his wife Eda Ak and his stepson Cem Sumerer.
