Law360 (April 30, 2021, 6:57 PM EDT) — A Puerto Rico federal judge on Friday rejected the U.S. Department of Homeland Security’s bid to shut down a suit from an officer who claimed he was unfairly boxed out of a promotion because of his Croatian nationality.

U.S. District Judge Gustavo Gelpi’s opinion and order disagreed with DHS’ arguments that Immigration and Customs Enforcement deportation officer Miodrag Plesha couldn’t bring his suit in federal court because he had allegedly already tried to resolve discrimination claims through his union’s grievance process.
